General Terms and Conditions (GTC)
Scope
For the use of this website as well as the business relations between CNBS Unlimited GmbH, Zähringerstrasse 13, 8001 Zurich (CH) and its customers, the following General Terms and Conditions apply in the version currently available and valid when calling up the website or when ordering goods. The offer on this website is aimed exclusively at customers with Swiss residence.
A customer is any natural or legal person who maintains business relations with CNBS Unlimited GmbH. The GTC, the terms of delivery and payment as well as the data protection regulations may be amended from time to timeen experienced. CNBS Unlimited GmbH asks you to read these provisions carefully every time you visit the website and when ordering goods.
These GTC apply exclusively. Conflicting, supplementary or deviating terms and conditions require the express written confirmation by CNBS Unlimited GmbH in order to be valid. When using this website or ordering goods, the customer confirms that he fully accepts these GTC, including terms of delivery and payment.
Should individual provisions of these GTC prove to be ineffective or unenforceable or become ineffective or unenforceable, this shall not affect the validity of the remaining provisions.

All information on www.cannabissommelier.ch (product descriptions, illustrations, films, dimensions, weights, technical specifications, accessory relationships and other information) are to be understood only as approximate values and in particular do not represent any assurance of properties or guarantees, unless explicitly stated otherwise. CNBS Unlimited GmbH endeavors to provide all data and information on this website correctly, completely, up-to-date and clearly arranged, but CNBS Unlimited GmbH can neither expressly nor implicitly guarantee this.
All offers on this website are subject to change and are not to be understood as a binding offer.
Prices
Unless otherwise stated, the prices of CNBS Unlimited GmbH include the statutory value added tax, any advance recycling fees (VRG) and copyright levies for electronic devices.
Any shipping costs will be charged additionally, unless otherwise provided, and must be paid by the customer. Shipping costs are shown separately in the order process.
We reserve the right to make technical changes, errors and typographical errors, in particular CNBS Unlimited GmbH may make price changes at any time and without prior notice. The sales prices do not include consulting and support services.
Conclusion
The offers on this website represent a non-binding invitation to the customer to order products and/or services from CNBS Unlimited GmbH. By placing an order via this website, including the acceptance of these GTC, the customer makes a legally binding offer to conclude a contract. CNBS Unlimited GmbH then sends an automatic “order confirmation” by email, which confirms that the customer’s offer has been received by CNBS Unlimited GmbH. Orders placed are binding for the customer. Unless otherwise stated, there is no right of return or withdrawal.
The contract is concluded as soon as CNBS Unlimited GmbH sends a declaration of acceptance by email, in which the dispatch of the ordered products or services is confirmed.
Orders will only be delivered after full payment has been received and if the goods are available.
Payment options and retention of title
The payment options specified in the order process are available to the customer.
CNBS Unlimited GmbH reserves the right to exclude customers from individual payment options or to insist on prepayment without giving reasons.
CNBS Unlimited GmbH may charge default interest of 5% per year as well as a reminder fee of a maximum of CHF 20.- per reminder in the event of default of payment by the customer.
The products delivered to the customer remain the property of CNBS Unlimited GmbH until full payment has been made.
Delivery, inspection obligation, notification of defects and return
Deliveries will be sent by post or courier service to the address indicated by the customer in the order. Invoicing takes place by email or by post. With the shipment, benefit and risk pass to the customer, as far as this is legally permissible.
If your order includes goods whose sale is subject to age restrictions, we will ensure that the customer has reached the required minimum age by using a reliable procedure (CH-Post ID check) including a personal identity and age check. The deliverer hands over the goods only after the age check has been carried out and only to the customer personally.
If the delivery cannot be delivered or if the customer refuses to accept the delivery, CNBS Unlimited GmbH may terminate the contract after a notification of complaint by e-mail to the customer and setting a reasonable deadline and invoice the costs for the activities.
The customer is obliged to inspect the delivered goods immediately after receipt of the delivery and to notify any defects for which CNBS Unlimited GmbH warrants immediately in writing by letter or email to the address in the imprint.
Returns to CNBS Unlimited GmbH are made at the expense and risk of the customer. The customer must send the goods in their original packaging, complete with all accessories and together with the delivery note and a detailed description of the defects to the return address provided by CNBS Unlimited GmbH in the imprint.
If the inspection by CNBS Unlimited GmbH reveals that the goods have no detectable defects or that they do not fall under the manufacturer’s warranty, CNBS Unlimited GmbH may invoice the customer for the activities, the return or any disposal.
Withdrawal
The customer is granted a right of withdrawal for 10 calendar days after receipt of the goods. The deadline shall be deemed to have been met if the customer sends the written revocation to CNBS Unlimited GmbH by e-mail (info@cannabissommelier.ch) or letter (CNBS Unlimited GmbH, Zähringerstrasse 13, 8001 Zurich) within the deadline. The revocation requires a drifting justification.
The exercise of the right of revocation leads to a reversal of the contract. The customer must return the goods within 10 calendar days in their original packaging, complete with all accessories and together with the delivery note to the return address specified by CNBS Unlimited GmbH in the imprint. Returns to CNBS Unlimited GmbH are made at the expense and risk of the customer. Any payment already made will be refunded to the customer within 20 calendar days, provided that CNBS Unlimited GmbH has already received the goods back or the customer can provide proof of dispatch.
CNBS Unlimited GmbH reserves the right to demand appropriate compensation for damage, excessive wear and tear or loss of value due to improper handling and to deduct the depreciation from the purchase price already paid or to invoice the customer.
No right of withdrawal is granted in the following cases:
- If the contract has a random element, namely because the price is subject to fluctuations over which the provider has no influence.
- If the object of the contract is movable property which, due to its nature, is not suitable for return or can spoil quickly;
- If the subject matter of the contract is movable property that is manufactured according to the consumer’s specifications or is clearly tailored to personal needs;
- If the subject matter of the contract is digital content and this content is not made available on a fixed data carrier or if the contract must be fulfilled in full by both parties immediately;
- If the contract has a service as its object and the contract is to be fully fulfilled by the provider with the prior express consent of the consumer before the withdrawal period has expired.
- In the areas of accommodation, transport, delivery of food and beverages and leisure activities, if the provider undertakes at the conclusion of the contract to provide the services at a specific time or within a precisely specified period.
Warranty
CNBS Unlimited GmbH strives to deliver goods of impeccable quality. In the case of defects notified in good time, CNBS Unlimited GmbH assumes the warranty for freedom from defects and functionality of the item purchased by the customer during the statutory warranty period of usually two years from the date of delivery. It is at the discretion of CNBS Unlimited GmbH to provide the warranty by free repair, equivalent replacement or by reimbursement of the purchase price. Further claims are excluded.
The warranty does not cover normal wear and tear as well as the consequences of improper handling or damage by the customer or third parties as well as defects that are due to external circumstances. Likewise, the warranty for consumables and wear parts (e.B batteries, rechargeable batteries, etc.) is excluded.
CNBS Unlimited GmbH is not able to give assurances or guarantees for the topicality, completeness and correctness of the data as well as for the constant or undisturbed availability of the website, its functionalities, integrated hyperlinks and other content. In particular, it is neither assured nor guaranteed that the use of the website will not infringe the rights of third parties that are not owned by CNBS Unlimited GmbH.
Liability
CNBS Unlimited GmbH excludes any liability, regardless of its legal basis, as well as claims for damages against CNBS Unlimited GmbH and any auxiliary persons and vicarious agents. In particular, CNBS Unlimited GmbH is not liable for indirect damages and consequential damages, lost profits or other personal injury, property damage and pure financial losses of the customer. We reserve the right to further mandatory statutory liability, for example for gross negligence or unlawful intent.
CNBS Unlimited GmbH uses hyperlinks only for the simplified access of the customer to other web offers. CNBS Unlimited GmbH can neither know the content of these web offers in detail, nor assume liability or other responsibility for the content of these websites.
Privacy
CNBS Unlimited GmbH may process and use the data collected in the context of the conclusion of the contract to fulfil the obligations arising from the purchase contract and to use it for marketing purposes. The data necessary for the performance of the service may also be passed on to commissioned service partners (logistics partners) or other third parties.

Other provisions
CNBS Unlimited GmbH expressly reserves the right to change these GTC at any time and to put them into force without prior notice.
In the event of disputes, only substantive Swiss law shall apply to the exclusion of conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Convention on Contracts for the International Sale of Goods) is explicitly excluded.
The place of jurisdiction is Zurich,unless the law provides for mandatory places of jurisdiction.
